To his Excellency Gov Magoffin —

The undersigned your petitioner states that he has been prosecuted in the Owen circuit court as he believes out of malice for a breach of the peace, and to save expense & further trouble in in his procuring witnesses to defend; the Commonwealth not being ready to try — he has confessed judgment ^at the present term of the court^ relying upon the mercy of the Governor to remit the Judgment rendered (one hundred dollars) except the costs; which he asks may be remitted — & further he will ever pray —
