Sir: Last fall we Sent you a copy of an order of Court Stating, that the Judge of the Madison Circuit Court refused to preside on the trial of Francis Searcy under an indictment for Murdur -- Whereupon you designated Judge Burns to presede on the trial of the case. Burns has gone out of office & the case has not been tryed. The residence of the Hon. Milton Durham is nearer to this place than that of any other Judge & no party will object to Judge Durham presiding on the trial -- C^ol Searcy desires a trial as early as possible & we hope you will immediately designate Judge Durham to preside
