James M^cGennis states that he was at H. P. Thorntons house a few days after the difficulty occured and in conversation with Miss Sutherland (who it is alledged was shot by W^m Baxter) she stated that she did not know who shot her that she could not believe the W^m Baxter (if he did shoot her) that he did it intentionally for she had nothing against W^m Baxter and he could have no grudge against her as they had no acquaintenance with each other she further stated in the scuffle with Lamb he Lamb got the Pistol from W^m Baxter and gave it to M^r Thornton and she threw it down behind the bed and Miss Sullivan picked it up and W^m Baxter [an]tried to get it from Miss Sullivan and Lamb came up and in the Scuffle the pistol went off amoung them but how it came to go off she could not tell but she did not believe that W^m Baxter shot it off (if he shot it atall) intentionally This was the substance of what she stated to this affiant

M^rs Sally Bell states that Miss Sutherland in conversation with her frequently on the subject of the difficulty in shooting ~~the~~ Miss Sutherland said to this Affiant that she was satisfied that W^m Baxter did not shot her intentionally (if he shot her atall) that she had nothing against W^m Baxter nor did Baxter have anything against her as they were not acquainted. This is the substance of what she ~~frequently~~ stated to this affiant This affiant was not a witness before the Court in the case against W^m Baxter She was unable to attend to Court

Anthony Thornton Says he has heard the affidavit of M^rs Sally Bell read and says that Miss Sutherland stated the Same in substance to this affiant

Mary Thornton states that she has heard the affidavit of M^rs Sally Bell read — and says that it contains the truth and Miss Sutherland further stated that H. P. Thornton & Lamb Kept at her and talked & persuaded her until she consented to bring the suit tho she did not want to do it that she did not believe that William Baxter intended to hurt or injure her in any way that she knew that he had nothing against her and she had nothing against him
