At a Circuit Court began and held for Henry County Ky at the Court House In the Town of New Castle on Monday September 1^st 1862

C. M. Humston

Upon the calling of this ~~[...]~~motion The atty for the Commth moved the Court for Judgement for the amount of all the excution mentioned in the Motion To Wit, The amt of $2360.27, together with 30 per cent therein for the faction of Said Humston^s late Sheriff as aford to return them to the office of the Clerk of the Henry Circuit Court within the time prescribed by & Requierd by law and thereupon the Said Defd. C M Humston came into Court and pled guilty and confessed Judement for the amt claimed by the Commonwealth in manner and form as Set fourth in Said Notice and Motion Werefore it is adjudged by the Court that the Defd is guiltly as charge and that the Commonwth recover ~~recover~~ of Said Defd
The Sum of Two Thousand Three Hundred and Sixty Dollars. & 27, cents, and also Thirty percent on the amount of Execution Not returned in the time required by Law as confessed by Said Defd. Making the whole amount of this Judgment in favor the Comth $3068.27. cts for which the Commth may have Execution also her Cost here in Expended.

The following is the affidavit of C. M. Humston.

C. M. Humston States that the following Execution named in the notice to him of a motion in the name of Comwth against him in the Henry Circuit Court have been remited by the Governor of this State and and probably others not recollected.

For cause Shown upon the affidavit of C M Humston filed in this Cause and on his motion it is ordered that the Judgement rendered herein on a former day of this term to the extent of $1670.95c be Set aside and to that Extent the motion is continued and the residue of Said Judgement stands in force and Execution may issue for $1397.32 cents
