This day came the parties by their attorneys, and by consent the arraignment of the prisoner is dispensed with. The defendant, plead not guilty to the indictment, thereupon the following Jurors viz: Jo^s H Swearingen, Sam^l M^cEldonney, A. W. Fryer, George Rowland W^m N. Frizzell James E White, W^m F. Swearingen, O W. Boyd, Danl E Hendrickson Ja^s S. Jones. H. A. Shepard — W^m N Carr —

who were duly empannelled and sworn. The defendant then asked and obtained leave to withdraw his plea of not guilty, and pleaded guilty to the indictment, and the Jury having heard the evidence, &c. returned the following verdict viz. We the Jury find the prisoner guilty and fix his punishment at four years imprisonment in the penitentiary of this state, but [recomment] him to executive Clemency and pardon on condition of his return to his regiment the 22" Ky Vols. It is now therefore adjudged that the prisoner be committed to the county Jail —
