We the undersigned Petitioners of Campbell County Kentucky. would most respectfully ask your honor to remit the fine assessed by our Circuit Court at its last May Term 1863, Against two Citizens of this town, for an alleged Riot, Said ~~Said~~ of been Committed at the last Agust Election 1862. The Circumstance are about as follows, Andrew Rhemer and Henry Dornheafer,, the parties charged as above, was members of the Home Gard at the time and acting under the orders of Deputy Provost Marshall Z S. Stroube, but at the time ~~of said~~ and place of said Roiot Depty Marshall being absent, Said Reihmer & Dornheafer hearing of a row being had at a drinking shop in this town made an arrest of one man who they thought acting a prominant part, and lodged him in Jail for a few hours, The parties made the arrest from Convictions of Justice. And in full faith of discharging their duty and
all persons thought it was made in Correct good faith,, and all seemed satisfied and indeed the person. as arrested but by the perswasions of Others was led to bring suit for damages., and at the time a hearing was had of the (Case the Deputy Marshall Z S. Stroube whose name you will find to this Petition) was absent from home, had he detaled the facts to the Court, their could not have Judgement against the parties above named. It is not the amount of fine which being ^assessed^ only $5.⁰⁰ Each & Costs, although poor Men, but acting as they believed in good keeping with instruction given them, And with no intention dooing any act to injure the feelings of any one, or the piece dignity of the Commonwealth of Kentucky, and heretofore have lived law abiding Citizens,
