To his excellency the govenor of the Commonwealth of Kentucky your petitioner Daniel G Baker will state at the last term of the Webster Circuit Court he was fined $60 under an indictment for an assault & Battery with Wood Monroe, the facts of the case as proven upon the trial was in substance as followeth — a brother of your petitioner & said Monroe engaged in a fight privately & in the Woods, No person being present except your petitioner & Green Tolly — your petitioner urged Tolly to part them — Tolly objected & the brother of your petitioner suceeded in the contest afterwards Tolly your petitioner & his s^d brother walked down to the house Monroe followed a short time thereafter- petitioners Brother there proposed peace, which was approbated by your petitioner; Monroe Commenced a second dificulty with petitioners brother & Stabed him with a Knife — and to prevent serious damage & to save his brothers life, he struck Monroe once with a small walking cane, for which he was Indicted & fined $60 this was all the testimony in the case wherefore he prays that s^d fine be remitted
