Thomas Howard being in custody charged with the offense of Larceny and being admitted to bail in the sum of three hundred dollars: now, we C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress and W. H. Herman of Muhlenberg County Kentucky, hereby undertake that the above named Thomas Howard will appear in the Muhlenberg Circuit Court on the first day of its next November term to answer said charge, and will at all times render himself amenable to the order and process of said court in the prosecution of said charge, and if convicted, will render himself in execution thereof, or, if he should fail to perform either of these conditions, that we will pay to the Commonwealth of Kentucky the sum of three hundred dollars witness our hands this 27^th day of september 1864

This day came the atty for the Commonwealth, and the defendant Thomas Howard having been called and failing to appear in the discharge of his bail bond or recognizance entered into on the 27^th day of Sept 1864, in the sum of $300, It is therefore adjudged by the court that said Bail Bond be and is hereby declared forfeited, and that a summons
is hereby awarded against C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress and W. H. Herman returnable to the first day of the next term of this court, to show cause if any they can why the Commonwealth shall not have Judgment against them for $300, as the sureties of the said Thomas Clark on said forfeited Bail Bond, for the appearance of the said Howard in this court on the 1^st day of its present term, & further to do &c,

Upon which summons issued & was returned by the sheriff of Muhlenberg County duly executed on the defts C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress & W. H. Herman on the 18^th day of April 1865,

The defendants C L M^cCoun, T. E. Fulkerson J. V. Fentress and W. H. Herman having been duly summoned & failing to answer, It is adjudged by the Court that the Commonwealth of Kentucky recover of the defendants C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress & W. H. Herman, the sum of three hundred dollars the amount of which they executed their bond — with interest at the rate of 6 per cent per annum from this date, and her costs herein expended,
