Your petitioners represent that at the June term of the Henderson Circuit Court one Arthur Payne was indicted tried and convicted of larceny and sentenced to four years confinement to the Penitentiary of the State

The case we think presents many features upon which we are justified in basing an application for clemency and pardon of your Excellency — Arthur Payne is a child in years and Size, is English by birth — came to this country when about seven years old and is now about fifteen — has been an orphan for several years and for that length of time friendless and homeless — Acting under the suggestion and influence of an older person he took away the horse and carried him to the State of Ind where he we was arrested — We believe that Your Excellency will do right in extending to the unfortunate boy the benefit of executive clemency and we confidently that you will do so — We append a copy of the verdict of the jury finding him guilty July 11^th 1865
