Against } Indictment for shooting with intent to Kill.
James Rice, John Holton Elijah Wiley Defendants

The Grand Jury of Bracken County, in the name and by the authority of the commonwealth of Kentucky, accuse James Rice, John Holton & Elijah Wiley of the offense of [ ][ ] committed as follows, viz:

The said James Rice, John Holton and Elijah Wiley on the [ ] day of February 1865 and on divers other days and times, before and since that time, and before the finding of this Indictment, in the County and State aforesaid with force and arms in and upon one Charles Hamilton, then and there being, did feloniously make an assault, and that the said James Rice, with a certain deadly weapon which he then and there had and held in his right hand, loaded with gunpowder, leaden balls and other deadly and distinctive substances commonly called a pistol at and against one Charles Hamilton then and there being wilfully and feloniously did shoot off and discharge, and that the said James Rice with the pistol aforesaid, loaded as aforesaid by means of shooting off and discharging the said pistol, to, at and against the said Charles Hamilton as aforesaid, did then and there, feloniously and wilfully, strike penetrate and wound the said Cha^s. Hamilton in and upon his right side

giving to him, the said Hamilton then and there with the leaden bullet aforesaid by means of said shooting and discharging the the pistol so loaded as aforesaid, to, at and against the said Hamilton, one dangerous wound of the depth of six inches and of the bredth of one ince with intent then and there feloniously to kill and murder the said Charles Hamilton, and the Jury aforesaid, in the name and by the authority aforesaid, do further say that the said John Holton and Elijah Wiley then and there wilfully and feloniously were present, aiding, helping abetting and assisting the said James Rice the said felony in manner and form aforesaid, to do and commit and so the Jury aforesaid, do say that the said James Rice, John Holton and Elijah Wiley on the day and year aforesaid in the County aforesaid in manner and form aforesaid, the said Cha^s. Hamilton, did feloniously shoot and wound, with intent then and there feloniously to kill & murder the said Charles Hamilton and against the peace and dignity of the Commonwealth of Kentucky,
