Francis M. Searcy who stands indicted in the Madison Circuit Court for the Murder of Woods Caperton & said Cause having been continued at the present September Term of the Madison Circuit Court because the Judge of Said Court declined to preside on the trial of Said Case & no member of the bar could be procured to act as special Judge & these facts having been Certified to the Governor for him to designate a Judge to try Said case ~~makes~~ the dft makes affidavit that he does not believe the Hon. Granville Pearl Circuit Judge for one of the Judicial districts for Ky will do him Justice in the trial of Said case & he therefore ofbjects to his being designated to try the case & prays that Some other Circuit Judge may be assigned by the Govenor to try the case
