To his Excellency B. Magoffin Governor of Kentucky

Your peitioners Granville Bushy and William Essex state that on the [ ] day of [ ] 1859 Israel Thomas was arrested in Maysville in Mason County for passing counterfeit money and held to bail for his appearance at the next term of the Mason Circuit Court, in the sum of fivehundreddollars — Your petitioners became his bail for his appearance The said Thomas failed to appear and the bail bond was forfeited and judgement rendered against your petitioenrs for said sum of $500 — and costs — They now state ^that^ said Thomas gave them a mortgage on a small tract of land in Lewis County to indemnify them — said land is worth some three hundred dollars and not more, at the same time he gave W H Wadsworth a leen on said land for fifty Dollars his fee in the sent — both liens as included in the Same mortgage= They state that said land is all the estate said Thomas owns — that he has a wife and three small children — if said land is sold his wife & children will be left without anything said land would not sell
for more than two hundred dollars with the wifes contingent right of dowermet — Your petitioners are poor men and unable to stand the loss — In order to protect themselves, and said Thomas wife and children they pray that you will remit all of said Sum of $500 except officers costs and fees —

I Seth Parker Sheriff of Lewis county, State that I am well acquainted with the petitioners Granville Bushy and William Essex, and that I am satisfied that their case in one demanding the interposition of executive clemancy — They are poor men with large families — The land upon which they have a mortgage is not worth more than $300 — and that is all the estate said Thomas has

I have known the petitioners many years and they are men in limited circumstances It will be a great hardship if they have to pay the $500

The statements in the above petitions, I am satisfied are true, and the effect of requiring the above penalty to be enforced will only be take from M^rs Thomas and her little children, all they have to live upon. She deserves a better fate, and I unite in asking that the penalty of the bond, so far as the Governor has a right to remit it, may be remitted,
