The undersigned would respectfully represent to your Excellency that Matthew MacNamara, has been fined in the City Court of Lexington One Hundred Dollars and Costs for an assault on William Malory We understand that he was provoked to make the assault by Malory charging him to his face that he had murdered his own wife And when the Case was brought into the Court M^r MacNamara confessed Judgement to the extent of the law.

The undersigned believe that he only acted in making the assault for such an outrage as any other man of spirit would have done, And that your Excellency will see at once that it is not the case of a man who wantonly violates the law We solicit you to remit the fine as far as it is in your power.

We believe Mr MacNamara to be a peaceable and good citizen,

I was one of Mr McNamara's counsel on the charge for killing his wife we urged trial every term & at last the Com^th dismissed the prosecution we had full proof by Dr Skillman that she died of disease & all the circumstances showed that it was a malicious prosecution. therefor Malorys charge of the crime on him was wholly circumstantial & of course aggravating
