at the Last Term of this Court an Order was made forfeiting the recognizance in the case dated July 4" 1862 conditioned in the sum of $800.00 that the Defendant John Neal should appear in this court on the 1^st day of its last Term to answer a charge of Felony

A summons was issued by the Clerk of this Court, against the defendant, John A Neal and John W Marquiss his bail requiring them to appear and show cause on the first day of this term against the rendition of Judgment against them in favor of the Commonwealth for the sum of $800.00. on account of said forfeiture which Summons was duly served on said defendants a sufficient time before the Commencement of this term, & both of said Defendants being before the Court, as well by service of process as by attorny & said defendants failing to show any sufficient cause against the rendition of Judgment The Commonwealth introduced the Clerk of the Court as a witness & proved by him that when the prosecution above named against Neal was called at the last term of this Court s^d Neal was called by the order of the
court and failed to appear as required by said recognizance and made default upon which said recognizance was forfeited He also proved that s^d Neal did not appear to answer said prosecution when the same was called at the present term of the Court. The Commonwealth then moved for Judgment against said defendants for the sum of $800.00. by reason of s^d forfeiture & no sufficient reason being shown why said Judgment should not be rendered.

It is Ordered & adjudged that the Commonwealth recover of the Defendants John Neal & John W Marquiss the sum of $800.00. for which sum the Commonwealth may have execution
