4,, The resignation of Captain Simon Rice Co. "B" 40th Ky, Volunteer Infantry is hereby accepted, to take effect February 26^th, 1864, with the condition that he shall receive no final payments until he exhibits satisfactory evidence from the head of the Ordnance Department, and the proper accounting officers of the Treasury, that he has made all prescribed returns, and is in no wise indebted to the Government.
