To his excellency James F Robinson Governor of the Commonwealth of Kentucky — your petetioner states that at the last Term of the ^Boyd^ Circuit Court(April 1863) he was fined fifty dollars ($50) for selling Liqour to an infant — ^towit^ Gobble Burgess — he says that Burges was a candidate for the office of Mayor was as he learned ^since^ under 21 years of age barely had been doing business for some time for himself your petitioner being a Lisensed Tavern Keeper in Boyd County — did let said Burgess have some Liquor to treat his friends as he said — that he did not know that he was violating the Law — said Burgess was an inteligent sober man and not doubting his being of age — he prays your excellency to remit the fine yours & c

I George Burgess of Boyd county — states that Goble Burgess is his son — that he was well grown & had been doing business for himself that Turman is his neighbour that he had permitted said son of his to trade with Turman — he was candidate as represented by Turman — He states his son is sober — ^& was going on 21 years old out of his 20^th I think — ^ He asks that the fine may be remitted against Turman believing in this instance and satisfied that Turman would do his son no injury — & ~~was~~violated the Law unintentionally this 4^th day of may 1863.

I was acting judge of the Boyd Circuit Court, at the time of the rendition of the judgment against The petitioner Turman and heard the evidence I am satisfied that Turman did not knowingly violate the Law, he supposed Gobel Burgess was in his majority.
