Thursday November 28^th 1861

The Council met pursuant to adjournment.
W. B. Machen President in the chair.

Mr H. W Bruce from a select committee appointed for the purpose reported as follows. Towit:

The committee raised by resolution to confer with Genl Buckner concerning certain funds report: That they have conferred with General Buckner and are informed by him that the Sheriff of Warren County either deposited in the Branch of the Bank of Kentucky at Bowling Green, about one thousand dollars, or paid the same to Lieutenant Colonel R. Johnson by whom it was so deposited if paid to him. The Sheriff then represented the money as belonging to the State. He says now however that upon investigation he ascertains that the money belongs to himself and desires permission to withdraw it- The money is under the control of General A. S. Johnston, with whom a conference is recommended

Thereupon Mr H. W. Bruce moved the following resolution Towit:
Resolved That a committee of two be appointed to confer with General A. S. Johnston concerning any money of the State of Kentucky under his control and the payment of the same to this government.
Said report was received and said resolution adopted

A petition from sundry citizens of Kentucky in reference to N. McC. Menifee- was received and read and on motion was referred to the committee on Military affairs

Mr Crockett moved the following resolution --
Resolved That a committee of one be appointed by the President of the Council to wait on Colonel N. M.^cC. Menifee and request him to meet with the Governor and council at their Council Chamber at half past 2 O'Clock Inst. and to impart to them such information as he may possess respecting our cause in Eastern Kentucky, and other matters in that portion of the State relative to the condition and prospects of the Provisional Government.
Which was adopted --
Thereupon the President appointed H. W. Bruce as said Committee-

Mr Bates moved a reconsideration of the vote by which the resolution was adopted authorizing the Governor to appoint a Bank Commissioner to take charge of funds in New Orleans held by Kentucky Banks- and also to reconsider the vote by which the act was passed prescribing the duties of said commissioner- and before the question was put upon said motion the mover was granted leave to withdraw the same.

Mr Crockett renewed the motion of Mr Bates- and the vote being taken thereon was decided in the affirmative-
and so said votes were reconsidered-
and then on motion the whole subject was referred to a select committee composed of Messrs Crockett and E. M. Bruce- with instructions to reduce the whole subject into one act --

Mr Thompson asked and obtained leave of absence until Saturday next.

And then the council adjourned until 2 O'Clock P. M.

The council re-assembled at 2 P. M W B. Machen President in the Chair

In pursuance of the resolution adopted in the morning Session the Committee, Mr H. W. Bruce introduced to the Governer and Council Col. N. M^cC. Menifee, whereupon Colonel Menifee proceeded to address the Council upon the subject of the affairs of the Southern rights cause in the Eastern portion of Kentucky

Messrs E. M. Bruce and Crockett the select Committee to whom was referred the subject of a Bank Commissioner to attend to the interests of the Banks of Kentucky at New Orleans and for other purposes reported a bill entitled "An act to empower the Governor to appoint a Commissioner to the Confederate States of America on the subject of Banks" which bill is a substitute for the action of the Council heretofore on that subject-

Said bill was read a first time-.
Ordered that said bill be read a second time.
The rules of the Council, Constitutional provision and second and third readings having been dispensed with-
The question was then upon the passage of the same, and being put, was decided in the affirmative -- and so the bill passed-
Ordered that the title be as reported

Mr E. M. Bruce from the Committee on Banks reported a bill entitled "an act regulating Currency" which was read a first time --
It was moved to dispense with the rules requiring the bill to lie on the table one day before being ordered to its second reading-
and the question being put it was decided in the negative-

Mr H. W. Bruce moved a reconsideration of the vote by which the council refused to dispense ^with^ the rules ordering said bill to its second reading, which motion prevailed- and so the vote was reconsidered
Ordered that said bill be read a second time
Mr Bates moved to dispense with the rules of the Council & Constitutional provision requiring a second reading- which motion prevailed- and so the bill passed into the orders of the day

A special Message from the Governor by R. McKee secretary was received:-

Mr President- I am directed by the Governor to lay before this Council a message in writing:

President of the Council of the Provisional Government of the state of Kentucky-

Sir I hereby nominate H. J. Lyon a commissioner, under an act entitled an act to empower the Governor to appoint a Commissioner to the Confederate States of America on the subject of Banks.

on motion the nomination of H. J. Lyon was unanimously confirmed

On motion of Mr Crockett a Committee on enrollments was added to the standing committees -- and thereupon the President appointed on said committee the following gentlemen- Towit Messrs Burnside Chairman, Thompson and H. W. Bruce.

Mr Burnside from the Committee on enrollments reported that they had examined an enrolled bill entitled "an act entitled an act to empower the Governor to appoint a Comissioner to the Confederate States of America on the subject of Banks" and had found the same truly enrolled- and thereupon the President affixed his signature thereto-

A messsage from the Governor by R. M^cKee Secretary of State was received announcing his approval of "an act entitled an act to empower the Governor to appoint a commissioner to the Confederate States of America on the subject of Banks"

Messrs H. W. Bruce and Bates from the select committee made the following report:

The Committee appointed to confer with General A. S Johnston concerning any money of the State under his control and the payment of the same to this government report:

That they called on General Johnston who stated to them that the money referred to would be Committed to the disposition of General Buckner and that he would approve whatever General Buckner should do in relation to it

And thereupon said Committee moved the following resolution=
Resolved- That the committee again confer with General Buckner and such other persons as may be necessary and report to the Council what action shall be necessary to secure the payment of any money of the State under his control to this Government --
Which was adopted

Mr H. W. Bruce moved the following resolution which reads Towit.
Resolved That the Provisional Governor is hereby requested if not inconsist with the public interest, to furnish this Council the copies of any acts of the Congress of the Confederate States of America, and any other information he has assuring the people of Kentucky that the Confederate States will aid them in achieving their political independence of the tyrranous despotism now oppressing them.

And then the Council adjourned until tomorrow at 10 O'Clock
