This day personally appeared before the undersigned a Notary Public, Andrew L. Robinson who after being sworn deposes and swears that the written named John W. Rutherford since the commission of the crime charged against him in the foregoing indictment has left the State of Indiana and is at the present term residing in the County of Crittenden in the Commonwealth of Kentucky
